PERSONAL DATA ADMINISTRATOR
The administrator of the personal data provided by you is TestRevolution sp. Z oo with its seat in Tarnowskie Góry (42-600), ul. Gliwicka 35, entered into the Register of Entrepreneurs of the National Court Register by the District Court in Gliwice, 10th Commercial Division of the National Court Register under the KRS number: 0000832174, NIP: 6452563868, REGON: 385150770, with a share capital of PLN 50,000.
Contact with TestRevolution as the administrator of personal data may take place in particular by e-mail via the e-mail address or by post to the address indicated in point 1.1. above.
METHOD OF DATA PROCESSING
The purpose and scope of the processing of your personal data is determined by the scope of consents and data completed by you sent via the appropriate form.
The processing of personal data may concern your name, surname, e-mail address, home address, correspondence address, IP number, telephone number, NIP number, REGON number, company name, Google, Github, Microsoft identifiers and payment card details (only for the payments).
It is also possible to process your personal data to the extent to which you will voluntarily enter them as part of the functionalities provided by TestRevolution. Therefore, we ask you not to enter your authentic personal data or personal data of third parties during the tests. At the same time, we would like to inform you that the data will be processed only to provide you with the possibility of conducting tests and verifying their results.
Your personal data will be processed for the following purposes:
fulfillment of obligations arising from legal provisions - the legal basis is the statutory authorization to process data necessary for the purpose of lawful operation (Article 6 (1) (c) of the GDPR);
providing services by electronic means as part of the testrevolution.io website - the legal basis is the statutory authorization to process necessary for the performance of the contract when the data subject is its party or when it is necessary to take action before concluding the contract at the request of the person to whom data concern (Article 6 (1) (b) of the GDPR);
performance of the contract concluded with you, with particular emphasis on providing you with the possibility of conducting tests using the TestRevolution software - the legal basis is the statutory authorization to process necessary to perform the contract when the data subject is a party to it (Article 6 (1) (b) GDPR);
undertaking promotional and commercial activities carried out by TestRevolution - the legal basis for processing is the legitimate interest pursued by TestRevolution (Article 6 (1) (f) of the GDPR) or voluntary consent (Article 6 (1) (a) of the GDPR).
Your personal data will be processed for the period of:
suitable for TestRevolution's demonstration of the proper performance of its obligations, the time being the length of the limitation period for claims;
resulting from the provisions of law, in terms of the obligation to store appropriate accounting documents.
in the case of marketing activities, until the given person objects to the further processing of their personal data for marketing purposes or until the consent to send marketing messages is withdrawn.
After the above-mentioned period, personal data will be deleted, unless their processing is necessary based on another legal basis.
In certain situations, TestRevolution may transfer your personal data to third countries (i.e. outside the European Economic Area), with particular emphasis on the United States of America. In the case of the US, this will be done under the EU-US Privacy Shield. In this case, TestRevolution will take all measures to ensure adequate protection of your personal data and will only transfer it to entities that guarantee an adequate level of data protection.
In the case of third countries other than the USA, the transfer of your personal data to them will only take place under the conditions resulting from art. 45 GDPR (data transfer based on an adequacy decision of the European Commission), Art. 46 GDPR (transfer subject to appropriate safeguards) or Art. 47 GDPR (transfer under binding corporate rules).
TestRevolution may entrust the processing of your personal data to third parties in order to ensure the functioning of the website, as well as the implementation of its rights or obligations related to processing. Then, the recipients of the data may be: the hosting provider, CRM service provider, e-mail operator, law firm, as well as the provider of functionalities allowing for payments within the portal (payment operators), statistical measurements and conducting marketing activities, the Chrome web browser provider.
Personal data collected by TestRevolution may also be made available to: relevant state authorities at their request on the basis of relevant provisions of law or other persons and entities - in cases provided for by law.
Each entity to which TestRevolution entrusts personal data for processing, based on a personal data processing agreement (hereinafter the "Entrustment Agreement") guarantees an appropriate level of security and confidentiality of personal data processing. The entity that processes your personal data on the basis of the entrustment agreement may process them, through another entity, only on the basis of prior consent
In the case of entrusting the processing of personal data to entities from third countries, such entrustment will be based on appropriate model contractual clauses or decisions of the European Commission with particular emphasis on the EU-US Privacy Shield, i.e. Commission Implementing Decision (EU) 2016/1250 of 12 July 2016).
TestRevolution may perform profiling for marketing purposes, i.e. in order to present you with an offer of its products and services tailored to your needs.
Profiling is the automatic assessment of certain personal factors relating to an individual. TestRevolution makes it in order to analyze your needs in the context of the TestRevolution offer and to present you with materials tailored to your preferences.
You will not incur any negative consequences in connection with the profiling, and your personal data will not be profiled to the extent other than the purpose indicated in paragraph 2.4.4. above.
To the extent that your personal data is subject to profiling, you are entitled to object to such activities, and to the extent to which the basis for processing is your consent, to withdraw it.
RIGHTS OF THE DATA SUBJECT
In connection with the processing of your data, you have the right to: (a) delete personal data collected about it, both from the system belonging to TestRevolution and from the databases of entities with which TestRevolution cooperates or cooperated, (b) restriction of data processing, (c) transfer personal data collected by TestRevolution about you, including to receive it in a structured form, (d) request TestRevolution to access your personal data and rectify it, (e) object to processing, (f) withdraw consent from TestRevolution at any time without affecting the lawfulness of processing based on consent before its withdrawal; (g) lodge a complaint against TestRevolution with the supervisory body (the President of the Office for Personal Data Protection).
TestRevolution can store http queries, therefore some information may be saved in the server log files, including the IP address of the computer from which the query came, name of the station - identification carried out by the http protocol, if possible, date and time of registration on the TestRevolution.io website and the arrival of the query, the number of bytes sent by the server, the URL of the page previously visited by you, if you entered via the link, information about your browser, information about errors, information about your device, identifiers of mobile devices (i.e. Apple Advertising Identifier). Logs can be collected as material for the proper administration of the website. Only persons authorized to administer the IT system have access to the information. Log files can be analyzed in order to compile statistics on website traffic and errors. Summarizing such information does not identify any individual.
TestRevolution uses technical and organizational measures to ensure protection of the processed personal data appropriate to the threats and categories of data protected, in particular, it protects technically and organizationally data against unauthorized disclosure, removal by an unauthorized person, processing in violation of the Act and change, loss, damage or destruction. . The set of users' personal data is stored on a secured server and the data is also protected by TestRevolution's internal procedures in the field of personal data processing and information security policy.
TestRevolution has also implemented appropriate technical and organizational measures, such as pseudonymisation, designed to effectively implement data protection principles, such as data minimization, and to provide processing with the necessary safeguards to meet the requirements of the GDPR and protect the rights of data subjects.
At the same time, TestRevolution indicates that the use of the Internet and services provided electronically may be at risk of malicious software (malware) getting into your ICT system and device, as well as unauthorized access to your data, including personal data, by third parties. In order to minimize these threats, you should apply appropriate technical security measures, e.g. using up-to-date anti-virus programs or protection of identification in the Internet. The website uses two types of cookies: (a) session cookies, which are permanently deleted at the end of the browser session; (b) persistent, which remain after the end of the browser session on the device, until they are deleted.
